Manifestation Determination Review

A Manifestation Determination Review (MDR) occurs when a student with a disability is subject to disciplinary action that may result in a change in placement, such as suspension or expulsion, for more than 10 consecutive school days.

The primary goal of an MDR is to assess whether the student's behavior was directly linked to their disability or resulted from the school's failure to properly implement their Individualized Education Program (IEP).

MDR procedures are designed to protect students with disabilities from being unfairly penalized for behaviors that manifest their disability. If the review determines that the behavior is connected to the disability, the school is required to adjust supports and interventions instead of proceeding with disciplinary removal.

  • Any other relevant person.

Determining if the conduct of the student is a manifestation of their disability

Observation and Analysis Phase

In this section, you need to give responses to the following two questions in Yes or No.

  • Was the conduct in question caused by or did the conduct have a direct and substantial relationship to the child’s disability?

  • Was the conduct in question a direct result of the school’s failure to implement the IEP?

Determination Phase

In this part, you ascertain either of the following two statements:

  • IS a manifestation of the disability, and the CCC will conduct a functional behavioral assessment (FBA) unless an FBA has already been conducted. The CCC will implement a behavioral intervention plan (BIP) for the student, or review and modify the existing BIP as necessary to address the behavior that led to the disciplinary removal. The student will be returned to their previous placement unless the school and parent agree to a change of placement as part of the BIP modification, or the student is assigned to an interim alternative educational setting for possession of a weapon, illegal drugs, or for inflicting serious bodily injury upon another person.

  • IS NOT a manifestation of the disability and school personnel may apply the relevant disciplinary procedures in the same manner and duration as would be applied to students without disabilities. However, the student must continue to receive appropriate services. The CCC must determine appropriate services needed to enable the student to continue to participate in the general education curriculum, although in another setting; to progress toward meeting the goals set out in the student’s IEP; and to receive, as appropriate, an FBA and behavioral intervention services and modifications that are designed to address the behavior violation so that it does not recur.
